October 10, 2005 -- Crosby & Higgins LLP recently settled a breach of contract action brought on behalf of New Jersey based Empire Resources, Inc., a worldwide distributor of aluminum products with operations reaching as far as Australia and New Zealand. The successfully resolved action concerning the delivery and acceptance without payment of a large order of unfinished aluminum by a Florida manufacturing company was brought in federal district court and raised numerous UCC, jurisdictional and “battle of the forms” issues.
